This End User License Agreement ("EULA" or "Agreement") is a legal agreement between you (either an individual or a single entity) and Flammable Penguins Games Ltd ("Company", "we", "us", or "our"), a company registered in England and Wales with company number 15845221, whose registered office is at Unit 3.33 The Busworks North Road, London, England, N7 9DP.
This EULA governs your use of any software, games, applications, and related services provided by the Company (collectively, the "Game").
By installing, copying, or otherwise using the Game, you agree to be bound by the terms of this EULA. If you do not agree to the terms of this EULA, do not install or use the Game.
Subject to your compliance with the terms of this Agreement, the Company grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to install and use one copy of the Game on a device that you own or control for your personal, non-commercial entertainment purposes.
Your rights to use the Game are limited by the terms of this license. You agree that you will not, under any circumstances:
All title, ownership rights, and intellectual property rights in and to the Game (including, but not limited to, any titles, computer code, themes, objects, characters, character names, stories, dialogue, catchphrases, locations, concepts, artwork, animations, sounds, musical compositions, audio-visual effects, methods of operation, moral rights, and any related documentation) are owned by the Company or its licensors. The Game is protected by the copyright laws of the United Kingdom, international copyright treaties and conventions, and other laws. All rights are reserved. This EULA grants you no title or ownership in the Game and should not be construed as a sale of any rights in the Game.
The Game may integrate with or require an account with third-party services (e.g., Steam, PlayStation Network, Xbox services). Features such as online multiplayer, leaderboards, and achievements may be provided by these third parties. Your use of such services is subject to their respective terms of service and privacy policies. The Company is not responsible for the availability, performance, or content of any third-party services.
By installing and using the Game, you consent to the collection, use, and storage of non-personal and anonymous information related to your gameplay. This data may include your session activity, device information, and crash reports. We use this data to improve the Game, provide services to you, and for analytics purposes.

When using any online features of the Game, you agree to abide by this code of conduct and the terms of service of any applicable third-party platform. You agree not to:
Violation of this Code of Conduct may result in the suspension or termination of your access to the Game's online features.
The Company may deploy or provide mandatory patches, updates, and modifications to the Game that must be installed for you to continue to play. The Company may update the Game remotely without notifying you, and you hereby grant to the Company consent to deploy and apply such patches, updates, and modifications.
This EULA is effective until terminated. You may terminate this EULA at any time by uninstalling the Game and destroying all copies in your possession.
The Company may terminate this EULA at any time, with or without notice, if you fail to comply with any of its terms and conditions. Upon termination, you must immediately cease all use of the Game and destroy all copies of the Game in your possession.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE GAME IS PROVIDED "AS IS" AND "AS AVAILABLE," WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND. THE COMPANY HEREBY DISCLAIMS ALL WARRANTIES AND CONDITIONS WITH RESPECT TO THE GAME, EITHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES AND/OR CONDITIONS OF MERCHANTABILITY, OF SATISFACTORY QUALITY, OF FITNESS FOR A PARTICULAR PURPOSE, OF ACCURACY, OF QUIET ENJOYMENT, AND OF NON-INFRINGEMENT OF THIRD-PARTY RIGHTS.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE COMPANY OR ITS AFFILIATES BE LIABLE FOR ANY SPECIAL, INCIDENTAL, INDIRECT, OR CONSEQUENTIAL DAMAGES WHATSOEVER (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF BUSINESS PROFITS, BUSINESS INTERRUPTION, LOSS OF BUSINESS INFORMATION, OR ANY OTHER PECUNIARY LOSS) ARISING OUT OF THE USE OF OR INABILITY TO USE THE GAME, EVEN IF THE COMPANY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
This EULA and any dispute or claim arising out of or in connection with it or its subject matter or formation shall be governed by and construed in accordance with the law of England and Wales. You agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim.
